Demanding a Refund: Briefer on the Human Settlements Adjudication Commission

The Human Settlements Adjudication Commission (HSAC)—reconstituted from the former Housing and Land Use Regulatory Board (HLURB) under Republic Act No. 11201—is the executive body tasked with resolving real estate disputes in the Philippines.

For buyers seeking a refund due to developer default, delayed delivery, or misrepresentation under Presidential Decree No. 957 (P.D. 957), the HSAC offers a structured administrative procedure.

Pre-Filing Requirements

Before initiating a formal action, the buyer should establish a legal cause of action. 

Has the developer failed to turnover or delayed in the development of the property? Does the developer lack a license to sell? Has the developer defaulted in the issuance of a refund despite continuous demand?

Compile all proof of the transaction, including the Contract to Sell, Reservation Agreement, Official Receipts, construction site progress photos, and relevant communications. Preserve these for lawyer to assess and study.

Drafting the Complaint

If the developer refuses or fails to comply with the demand, the buyer initiates the case by filing a Verified Complaint.

Submit the complaint to the HSAC Regional Adjudication Branch (RAB) having territorial jurisdiction over the project’s location or the principal residence of the parties. 

For projects located in Cebu and Cebu Province, the HSAC RAB VII has jurisdiction.

Summons and Answer

Upon payment of docket fees, the HSAC issues a Summons directing the developer (Respondent) to file a verified Answer within fifteen (15) calendar days from receipt. Failure by the developer to file an Answer may result in the case being resolved based on the evidence presented by the buyer.  

Mandatory Mediation and Position Papers

The HSAC schedules a mandatory conference to encourage an amicable settlement. If both parties reach a compromise regarding the refund amount and payment schedule, a Compromise Agreement is executed, which carries the weight of a final judgment upon approval.  

However, if settlement fails, the Regional Adjudicator directs both parties to submit their respective verified Position Papers together with supporting affidavits and evidence.

Decision and Execution

The Regional Adjudicator renders a decision based on the pleadings and evidence submitted. Under P.D. 957, if delay or breach is proven, the decision will order the developer to refund the total payments made, including amortization and interest, without forfeiture.  

Once the decision becomes final and executory, the buyer can file a Motion for Execution. The HSAC will issue a Writ of Execution directing the sheriff to attach the developer’s bank accounts or properties to satisfy the refund award. Decisions may be appealed to the Commission En Banc before seeking judicial review with the Court of Appeals.
